This Legal Notice regulates the use and access to the websites www.hotels001.com, owned by the joint controllers. Access attributes the status of user (hereinafter, the User) and implies full and unreserved acceptance of all provisions included in this Legal Notice, the Privacy Policy, and the Cookies Policy.

The User agrees to make proper use of the Websites in accordance with the law, good faith, public order, traffic customs, and this Legal Notice, being liable to the owners or third parties for any damages that may be caused by non-compliance.

The User guarantees the authenticity and currency of the data provided and undertakes not to use the content and services to:

• Spread illegal, violent, pornographic, racist, xenophobic, or offensive content.
• Introduce computer viruses or alter physical or logical systems of the owners or third parties.
• Access restricted areas or extract information without authorization.
• Violate intellectual or industrial property rights.
• Impersonate another user.
• Reproduce, distribute, or publicly communicate the content without written authorization.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on the Websites (texts, photographs, graphics, images, icons, technology, software, graphic design, and source codes) is the intellectual property of FuerteItaka, S.L., New Fit Canarias, S.L., or third-party licensors. The brand and associated distinctive signs are owned by the data controller. Total or partial reproduction without express written authorization is prohibited, in accordance with Royal Legislative Decree 1/1996, of April 12, which approves the consolidated text of the Intellectual Property Law, and Law 17/2001, of December 7, on Trademarks.

7. EXCLUSION OF WARRANTIES AND LIABILITY

The owners are not responsible for damages derived from errors or omissions in the content, lack of availability of the Websites, or transmission of viruses, despite having adopted all necessary technological measures. They also do not guarantee the absence of elements that may alter the User’s computer system.

8. LINKS TO THIRD PARTIES

The Websites may contain links to third-party sites over which the owners exert no control and assume no responsibility for their content, availability, quality, or veracity. The inclusion of these links does not imply association, merger, or participation with the entities owning said sites.

9. RIGHT OF EXCLUSION

The joint controllers reserve the right to deny or withdraw access to the Websites without prior notice to those users who violate this Legal Notice.

The joint controllers may modify the conditions of this Legal Notice, as well as the content and services offered through the Websites, without prior notice.

11. APPLICABLE LAW AND JURISDICTION

Relationships between the owners and the User are governed by Spanish law. For the resolution of disputes, the parties shall submit to the Courts and Tribunals of the User’s domicile in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users (TRLGDCU). If the User resides outside of Spain, both parties submit to the Courts and Tribunals of Las Palmas de Gran Canaria.
